Call to Order The general business meeting of the Board of Education was called to order by Chairperson Debi Hartmann at 7:40 p.m. in the Board Room, Queen Liliuokalani Building. II. Board's Recognition of Achievements in the Public Schools and Public Libraries 1. Presentation of Monetary Gift by GTE Hawaiian Tel for the Public Schools of Hawaii Foundation and to Governor Sanford B. Dole Intermediate School Presentation of the 1993 Public School Grant of $20,000 from GTE Hawaiian Tel, represented by Mr. Warren Haruki, was accepted by Chairperson Hartmann on behalf of the Public Schools of Hawaii Foundation. The grant is to underwrite the startup costs for the School Information Technology Training Program to make DOE employees technology literate. Presentation of a $5,000 grant to Governor Sanford B. Dole Intermediate School was accepted by Principal Geraldine Ichimura to purchase equipment to complete the school's Local Area Network (LAN). Superintendent Toguchi also acknowledged the partnership with IBEW, Local 1357 for its volunteer work in wiring the 24 classrooms for this project. III. Advisory Councils. Advisory Commissions. and Student Representatives The Chair of the Hawaii State Student Council (HSSC), Akiko Uyeda, reported on the current activities of the Council, focusing on the electronic student-at-work project, which is a statewide electronic communications network comprised of HSSC members and representatives from private and public schools. Honolulu District School Advisory Council Chair, Don Johnson, presented a written summary of the Council's annual report. IV. Requests, Petitions. Etc. from the Public Ms. Donna Wong addressed the Board regarding her son's poor attendance record at Kailua High School and that she was not immediately notified of the situation. Testimony against the proposed 22-credit graduation requirement was heard from Ms. Sharon Mahoe of HSTA; and Mr. Cal Kawamoto, Chairman of the Leeward School Advisory Council and Chairman of the Waipahu Neighborhood Board (Attachment A). Testimony was heard against the proposed Hale Kewalo Housing Development project from Mr. Richard Sakamoto, McKinley Alumni Association President (1989-92) and former McKinley High School Principal (Attachment B); Mr. Paul Izumi, McKinley High School junior (Attachment C); Ms. Vanessa Lee, McKinley High School Student Body President (Attachment D); Mr. Paul Kadooka, President, McKinley High School PTSA (Attachment E); Ms. Lisa Kadooka, Student (Attachment F); and Mr. David Hagino (Attachment G). With a motion made by Mrs. Miura and seconded by Mrs. Matsumoto, recess was called at 9:00 p.m. The meeting was recalled to order at 9:18 p.m. V. Approval of Minutes, Appointments, Contracts, Gifts and SCBM Status A. Minutes A motion was made by Mrs. Miura and seconded by Mr. McMillen to approve the minutes of executive sessions held on May 30, 1993, June 3, 1993 and June 17, 1993. The motion carried and the minutes were approved. B. Personnel Appointments Mr. Nakano reported that the Personnel Committee met to review the Superintendent's recommendations for educational officer appointments. The committee recommended approval. The motion carried unanimously C. Contracts The Superintendent brought before the Board for approval two (2) contracts with Dr. John Woodward for services as a consultant/trainer to assist schools in the development and achievement of the School Improvement Plans. It was moved by Mr. Nakano and seconded by Mr. McMillen that the Board of Education approve the two contracts as submitted by the Superintendent. The first contract for the period January 4, 1993 to January 29, 1993 in the amount of $10,550 was questioned by Mrs. Miura why Board approval is being requested months after the effective period. Superintendent Toguchi explained it to be a staff oversight to which he issued a serious directive that it not occur again. Mr. McMillen moved and Mrs. Miura seconded for a division of the motion to vote on each contract separately. The motion carried unanimously. It was moved by Mr. McMillen and seconded by Mr. Nakano that the Board approve the contract with Dr. John Woodward as consultant in the amount of $8,116, effective September 13, 1993 to September 21, 1993. The motion carried unanimously. It was moved by Mr. McMillen and seconded by Mr. Nakano that the Board approve the contract with Dr. John Woodward for his services as consultant from January 4, 1993 to January 29, 1993, in the amount of $10,550. It was moved by Mr. McMillen and seconded by Dr. Fox that the Board approve acceptance of the following gifts totaling $7,500, as recommended by the State Librarian: Gift to the Hawaii State Library of specially constructed display panels at a cost of $5,000, to exhibit the Freedom Shrine documents for public viewing. Approval of Ala Wai, Kekaha, Pope, Waimalu, Mililani-Uka and Kamaile Elementary; Dole Intermediate; and Mililani High SCBM Proposals to Implement (Student Affairs Committee) It was moved by Ms. Smith and seconded by Mr. Nakano that the Board approve Ala Wai Elementary, Waimalu Elementary, Pope Elementary, Mililani-Uka Elementary, Kekaha Elementary, Kamaile Elementary, Dole Intermediate and Mililani High's proposals to implement. The motion carried unanimously. VI. Communications Chairperson Hartmann notified Board members that recommendations on waivers and exceptions will be worked with a limited turn-around time by committee for the upcoming August 19th meeting. She suggested Board members review the recommendations and have their questions answered prior to the Board meeting. A motion was made by Mr. McMillen and seconded by Mr. Nakano to add to the agenda two resolutions for discussion and approval as item VIII.C.2. The motion carried. Mrs. Miura distributed evaluations of the Board's workshop and requested that Board members fill them out. VII. Reports A. Superintendent/State Librarian Superintendent Toguchi referred to his report folder and reviewed the Update (Exhibit 1); memoranda and letters for information and responses to Board members requests and concerns. Hawaii District Superintendent, Dr. Alan Garson, reported an update regarding the media coverage of incidents concerning Konawaena High School's "Race to the Sun" solar car competition that took place in Australia. State Librarian Kane's report pertained to: the Governor's memo regarding the supplementary budget; application for a one-time federal grant to establish a National Center for Literacy and Learning Disabilities; and the progress of the self-directed work team and the call for pilot sites, requesting committee assignment for other considerations concerning Project Slimmer as well. Lastly, Mr. Kane reminded Board members that they have been invited to the four institute days to be held in August. B. Board Committees Mr. McMillen reported that the Hawaiian Education Committee is embarked on a study mission relative to whether the Immersion Program should be expanded. A meeting has been scheduled for August 27 of the advisory councils on Hawaiiana and will report back to the Board in September. Mrs. Matsumoto reported that the Committee on Special Education and Special Services met and approved for recommendation to the full Board revisions to Chapter 36. Dr. Fox reported the Committee on Curriculum Instruction received the Department's recommendations for the Community-Sponsored Activities. VIII. Recommendations for Action A. Committee Recommendations 1. Approval to Renovate Special Education Class at Honokaa High and Elementary School (Committee on Business Services) It was moved by Mr. Nakano and seconded key Mrs. Apo that the Board approve the the expenditures to renovate a special education classroom in Building H at Honokaa High and Elementary School per Act 21 (1993) [H.B. 1143. S.D.2. H.D. 1. Relating to Public Contracts]. The motion carried unanimously. 2. Approval of Recommended Appointments to the State Advisory Council for Adult and Community Education (Committee on Adult, Community & Early Childhood Education) It was moved by Mr. McMillen and seconded by Mr. Nakano that the Board approve the appointments of Fran Kitagawa, Robert Kakiuchi, and Saxon Nishioka, and the reappointment of Laurene Oride to the State Advisory Council for Adult and Community Education, effective immediately. The motion carried unanimously. 3. Approval of the Establishment of and Recommended Appointments to the Incentive and Innovation Grant Review Panel (Committee on Curriculum and Instruction) It was moved by Dr. Fox and seconded by Mrs. Miura that the Board approve the appointments of Debra Nakama (Parent), Lea Cuevo (Student), MaryAnn Kadooka (Teacher), Blanche Suga (Teacher), Benjamin Lapilio (Principal), Dr. Elizabeth Ayson (Principal), Kazumi Ishihiro (School Support Staff), Harris Hirata (Business Person), and Lt. Donna Vaught (Military Person) to the Incentive and Innovation Grant Panel, effectively immediately, for a term of two years. The motion carried unanimously, 4. Re-affirmation of BOE Approved Changes to Regulations 4540.1, Graduation and Related (Committee on Curriculum and Instruction) It was moved by Dr. Fox and seconded by Mr. Nakano to postpone item VIII.A.4. to next Board of Education meeting. The motion carried. B. Unfinished Business None. C. New Business 1. Approval of Proposed BOE Committee Assignment Schedule (BOE Chairperson) It was moved by Mrs. Miura and seconded by Mr. Sakurai that the Board approve the proposed revisions to the 1992-1993 BOE Committee Assignment Schedule, dated July 29, 1993. The motion carried unanimously. 2. Board of Education Resolutions It was moved by Mr. McMillen and seconded by Mr. Sakurai to approve the resolutions. The motion carried. IX. Concerns/Future Agenda Items Mr. Nakano received a letter from Dennis Mateo, Chair of the Maui District School Advisory Council, who requested an increase in their budget. He would appreciate if the Superintendent and the Librarian would submit written information or reports to the Board members as to how they determine the allocation for Maui District for the LAC and SAC. Mr. McMillen stated two concerns. One is to settle the issue of legal counsel for the Kewalo project for McKinley High School. He thinks they should settle this matter once and for all. If the AG's office is in conflict, then they should allow the Board to hire outside counsel. Second, they should help with the Kewalo project if the Board feels they belong there. Mrs. Hartmann agreed there is a problem with the lawyer/client relationship. Dr. Fox requested that Mrs. Hartmann include in the discussion the attorney/client relationship between the Deputy AG and the Board, with particular emphasis on the question of confidentiality. Mr. McMillen stated they are beginning to divide up the 3,000 acres at Barbers Point. There is a school at that location and it could be lost unless the Board steps in. He would like the Superintendent to take a look at this matter to protect the school. In response to Mr. McMillen, Mr. Toguchi stated they have looked at this matter. If there's still housing there, then they won't lose any student population. The Department will certainly stay on top of this issue. Dr. Fox is concerned about how the Department calculates the high school drop out rate. It appears they only count the seniors who drop out of school. However, kids do drop out in the 9th, 10th, and 11th grade. In response to Dr. Fox, Mr. Toguchi stated it has been difficult to capture that kind of information. The ultimate solution will be the student information system and the Department is having a hard time tracking students because some of the students are part of the military community, some just leave, and some students transfer to private schools. Dr. Fox is most uncomfortable about comments made by a member of the public about him as a member of the Board. The Chair or the members of his committee did not make any comments about this incident. He was profoundly offended not only by the license taken by the individual, who is not a member of the Board, but also by the absence of any comments by his colleagues in the defense of one of their Board members. Regardless of his point of view, he would not tolerate something like that if it were directed toward another Board member. Mrs. Hartmann stated she will seriously consider what Dr. Fox has said and appreciated him bringing this to the Board's attention. X.
